Terms of Service

These Terms of Service ("Terms") govern your use of the goEnpLAY! mobile application and related services (the "App"), operated by Joemarie Amar (jomsoftware) in Bacolod City, Philippines. By creating an account or using the App, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App. If you are under 18, a parent or guardian must agree to these Terms on your behalf. A club may set its own age rules for entry, coaching or competition, and those apply at its venue. By using the App, you confirm that the information you provide is accurate and that you are legally able to enter into these Terms.
2. Your account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You may sign in using email/password or a third-party provider (Google or Facebook).
- Notify us promptly of any unauthorized use of your account.
3. Bookings and payments
- Booking a court holds the slot for 15 minutes while you pay. If payment is not completed in that time the hold is released automatically and the slot goes back on sale — nothing is charged.
- A booking becomes confirmed only on our side, never on your phone's say-so: when the payment provider tells us the money arrived, when club staff record that you paid in person, or when a membership's included hours cover the booking outright.
- Payments are processed by PayMongo via GCash or Maya. Prices are set by the club and shown before you pay.
- Where more than one discount could apply — a membership rate, a promotional code, a loyalty reward — the better one applies, never both. Included membership hours are used first.
- Club staff can also make a booking for you at the counter and record a cash or e-wallet payment against it.
4. Cancelling, rescheduling and refunds
- Each club sets its own cancellation rule: a cut-off measured in hours before the start, and how much is refunded after it. Cancel at or before the cut-off and the refund is in full; after it, the club's late-refund percentage applies, which may be nothing.
- The rule that applies is the one shown on the booking screen for that club at the time you book.
- Refunds are returned to the payment method that paid, through PayMongo, and can take several banking days to appear. A cash payment taken at the counter is refunded by the club at the counter.
- Rescheduling, where a club offers it, moves the same booking to another time; it is not a refund and does not create a new payment.
- If a club cancels on you, you are refunded in full.
5. Memberships
- A membership is sold by a club and is good only at that club. Its price, length and benefits — a discount, complimentary hours, a longer booking window — are the club's to set.
- Memberships do not renew automatically. Nothing is charged to you when a period ends; we remind you, and you choose whether to buy another. You will not find a stored card being billed, because there is none.
- Benefits stop the day after the period ends. Complimentary hours are spent as you book and do not carry over.
- Cancelling or refunding a membership mid-period is the club's decision, not ours.
6. Loyalty points and referrals
- Points are earned and spent per club. They are not transferable between clubs, not transferable between people, and have no cash value.
- Each club decides whether to run a programme at all, what earns points, what they are worth, and when it ends. Points are the club's promise to you, not ours.
- Points earned in error, or on a booking that is later refunded, can be reversed.
- Referral rewards require the person you referred to actually play — signing up alone does not earn one.
7. Open games, and money between players
- A player who books a court may open it as a game for others to join. The host pays the club for the court. Everyone else settles their share directly with the host, off the platform, by whatever means you agree between you.
- We do not hold, move, or guarantee that money. The app records what each share is and lets the host mark it settled or mark a player a no-show; those marks are the host's record, not a payment.
- If a game is cancelled, the host's refund follows the club's ordinary cancellation rule in §4. What the host then owes the joiners is between them.
- Clubs may switch games off at their venue. Joining strangers' games is your choice, and the ordinary rules of conduct below apply.
8. Teams and tournaments
- Tournaments are run by clubs. Entry fees, formats, schedules and results are theirs to set and publish; we provide the software.
- For a team entry, the captain enters the team and pays the whole fee. Sorting out shares within a team is the team's business.
- Withdrawal, substitution and refund of an entry fee follow the organising club's rules.
- Matches are scheduled onto real courts, so a fixture occupies a slot like any booking.
9. Messages, reviews and conduct
- You can message a club you play at, and everyone in a game can see and write in that game's thread. There is no private player-to-player messaging.
- You may leave one review per club, after a booking there is complete. Reviews are public and published under your name. We may hide a review that breaks these Terms; we do not rewrite it.
- Anyone can report a message. We may remove content, and suspend or terminate an account, for harassment, threats, hate speech, spam, sexual content, impersonation, or anything unlawful.
- You agree not to use the App for any unlawful purpose, to interfere with or attempt to gain unauthorised access to it, or to make fraudulent bookings or payments.
10. Buying and renting at the counter
- Clubs sell goods — drinks, equipment, court hire of rackets — at their counter through our software. That sale is between you and the club.
- Hired equipment stays the club's property and must be returned by the time agreed, in the condition you took it.
- A club may charge for damage or a late return as an ordinary sale. Refunds and exchanges on goods are the club's policy.
11. Clubs and third parties
Clubs are independent businesses, responsible for their courts, their staff, their prices, and the services they provide. We are not liable for the acts, omissions, condition, or availability of any club. A club also keeps its own records about you as its customer — including notes and tags its staff write — and is separately responsible for them; see our Privacy Policy for what a club can and cannot see. Third-party services (Google, Facebook, PayMongo, Expo) are governed by their own terms.
12. Service availability
We aim to keep the App available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.
13. Limitation of liability
To the maximum extent permitted by law, goEnpLAY! and its operator are not liable for any indirect, incidental, or consequential damages arising from your use of the App. The App is provided "as is" without warranties of any kind. In particular, we are not a party to money settled between players in a game (§7), nor to what you buy at a club's counter (§10).
14. Termination
You may stop using the App and delete your account at any time (see our Data Deletion instructions). Deleting your account removes your profile and everything that identifies you; records of bookings and payments stay, without your name, because a club has to keep the record of a sale. We may suspend or terminate accounts that violate these Terms.
15. Governing law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be subject to the jurisdiction of the courts of Bacolod City, Negros Occidental.
16. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
